Notice on the use of personal data


NOTICE PURSUANT TO ART. 13 LEG. DEC. 196/2003


1. Scope of the notice
This notice is published pursuant to art. 13 of Leg. Dec. no. 196/2003, Personal data protection code (hereafter “Code”) for those interacting with the web services of PROFIL PLASTIC S.R.L. (“PROFIL PLASTIC”) accessible via the internet at www.profilplastic.it (“Site”). The notice applies to the Site and to any other website attributable to PROFIL PLASTIC to which users are transferred by direct link. The notice does not apply to other websites to which the user may be redirected from the Site, not attributable to PROFIL PLASTIC and for which PROFIL PLASTIC is responsible for neither content nor privacy procedures.

The data collected through the Site is stored at the Data controller's headquarters and is processed solely by data processors and by those in charge of scheduled maintenance operations.


4. Type of data collected

Browsing data
The information systems and software procedures used to operate the Site acquire personal data in the course of normal operations. Providing personal data is implicit in the use of Internet communication protocols. These types of data (browsing data) are used solely for the purpose of obtaining anonymous statistical information on Site use and to check correct Site operation. Data may be used to ascertain responsibility in the event of cyber crime against the Site.

Data provided voluntarily by the user
The optional, explicit and voluntary sending of e-mail to the addresses given on the site implies the subsequent acquisition of the sender's address, which is required to respond to the customer's/user's requests. Focused information is given on Site pages where requested services are available.

PROFIL PLASTIC may use third-party ad serving for ads and to optimise its marketing activities. Some of the information collected by third-party ad serving may include data such as geolocation (obtained from the IP address), or contact information such as an e-mail address when collected by this Site.


6. Option to provide data
Except when specified for browsing data, PROFIL PLASTIC collects personal data, such as first name, surname, e-mail address, country of residence and other information, which is provided voluntarily by Site users. This data will be used to provide the requested information and services, respond to queries from users, and for advertising, sale and product development purposes. In particular, data contained in CVs, provided voluntarily, will be used by Human Resources Management in compliance with the purposes for which it was given, i.e. staff recruitment. Providing personal data on registration forms is optional. However, failure to provide data may mean the requested services cannot be provided. In some cases the Personal Data Protection Guarantor may request news and information pursuant to art. 157 and following of the Code, for the purposes of checking personal data use. In these cases, a response is obligatory under penalty of administrative fine.


7. Use method
Personal data is used with computer devices for the time strictly necessary to fulfil the purposes for which it was collected. Personal data will be used solely by PROFIL PLASTIC and will not be shared with or divulged to third parties. Specific security measures are put in place to prevent data loss, illicit or incorrect use and unauthorised access.

8. Rights of the interested party

The interested party may contact the Data controller to exercise his/her rights under the Code (article 7, given in full below), and, in particular, access his/her data, ask for it to be amended or updated, or oppose its use for legitimate reasons. Right of access to personal data and other rights

1. The interested party has the right to obtain confirmation of the existence of his/her data, even if not yet recorded, and its availability in an intelligible form.

2. The interested party has the right to know:

a) the origin of the personal data;

b) how and why data is used;

c) the logic applied if data is collected using electronic instruments;

d) the identification of the data controller, responsible parties and designated representative pursuant to art. 5, section 2;

e) parties or categories of parties with whom personal data may be shared or to whom it may become available in their role as the designated representative in the State territory, responsible parties or appointed persons.

3. The interested party has the right to:

a) update, correct or, when relevant, integrate data;

b) delete, transform to anonymous form or prevent data being used in breach of the law, including data not needing to be stored in relation to the purposes for which it was collected or subsequently used;

c) confirmation that those with whom data has been shared or divulged have been informed of the operations pertaining to letters a) and b), including the content, except in the event such a step is impossible or implies the use of means manifestly disproportionate to the protected right.

4. The interested party has the right to oppose, in whole or in part:

a) the use of his/her personal data for legitimate reasons, even if such data is pertinent to the purpose of the collection;

b) the use of his/her personal data for the purposes of sending marketing or direct sales material or to carry out market research or commercial communication.
